General Terms and Conditions (GTC)
for coaching services
1. Scope
1.1 These General Terms and Conditions (GTC) apply to all contracts for coaching services between [name of coach], [address], (hereinafter referred to as "coach") and its customers (hereinafter referred to as "customer").
1.2 Any deviating agreements, changes or additions must be made in writing. Any conflicting general terms and conditions of the customer will not be recognized unless the coach expressly agrees to their validity in writing.
2. Subject matter of the contract
2.1 The coach provides his services on the basis of an individually agreed coaching contract.
2.2 Coaching is a free, active and self-responsible process. The coach supports the client in developing their own solutions and assumes no responsibility for achieving specific results.
3. Conclusion of the contract
3.1 A contract is concluded when the customer accepts the coach’s offer or when both parties enter into a written agreement.
3.2 Verbal agreements only become effective upon written confirmation by the coach.
4. Services and Fees
4.1 Coaching services are provided in personal sessions, by telephone or online.
4.2 The amount of the fee and payment terms are specified in the coaching contract.
4.3 All prices quoted are final prices. According to Section 19 of the German Value Added Tax Act (UStG), no sales tax is charged (small business regulation), where applicable.
5. Appointments and cancellations
5.1 Agreed appointments are binding.
5.2 If the customer is unable to attend an appointment, the cancellation must be made at least 24 hours before the start of the session. If the cancellation is not made in time or the customer does not show up for the appointment, the full fee will be due.
5.3 The coach reserves the right to cancel or postpone an appointment for important reasons. In this case, an alternative date will be agreed.
6. Liability
6.1 The coach is not liable for damages resulting from the application of the knowledge or measures developed in the coaching process, unless these are due to intentional or grossly negligent conduct on the part of the coach.
6.2 Coaching is not a substitute for medical, psychotherapeutic or other medical treatment. The customer is responsible for his or her own physical and mental health.
7. Confidentiality
7.1 The coach undertakes to treat all information obtained during the coaching session as strictly confidential.
7.2 Information will only be passed on to third parties with the express consent of the customer, unless the coach is legally obliged to disclose it.
8. Data Protection
8.1 Personal data is processed in accordance with applicable data protection laws, in particular the GDPR.
8.2 Further information on data processing can be found in the privacy policy on the coach’s website.
9. Final provisions
9.1 Changes and additions to these Terms and Conditions must be made in writing. This also applies to changes to the written form requirement itself.
9.2 Should individual provisions of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a legally permissible provision that comes closest to the economic purpose of the invalid provision.
9.3 The law of the Federal Republic of Germany applies.
9.4 The place of jurisdiction for all disputes arising from this contract is the registered office of the coach, provided that the customer is a merchant, a legal entity under public law or a special fund under public law.
